Florida Family Files Wrongful Death Lawsuit After 6-Year-Old Dies In Go-Kart Crash

GoKartTrack

Tragedy struck a Florida family at an adventure park in Florida when their 6-year-old daughter was fatally injured in an accident involving a go-kart. The family has since filed a lawsuit against the business, claiming there were numerous safety violations that led to the child’s death.

This case shows how important it is for places like amusement parks to ensure the safety of all their visitors.

What happened at the Port St. Lucie adventure park?

According to WFTV, the parents of a 6-year-old girl have filed a lawsuit against the trampoline park where their daughter lost her life in a December 2025 incident.

According to the lawsuit, the girl was inside an electric go-kart with her mother when the vehicle began moving at a very fast pace and crashed into the track’s wall, causing severe injuries and eventual death.

Additionally, the lawsuit suggests that the attraction had previously been shut down because the regular operator had gone home and another employee had reopened it and operated it alone. The case raises questions about whether or not the decedent should have been allowed to drive a go-kart since she was underage and did not meet the size requirements set forth by the manufacturer. According to the recommendations, drivers need to be at least 18 years old and 60 inches tall. The decedent was only six years old and 49 inches tall.

State investigation identified safety violations

The Florida Department of Agriculture and Consumer Services conducted an investigation into the incident and found several violations of the state’s safety regulations for amusement rides.

The investigation uncovered that the decedent did not have her seatbelt on, and the go-kart was speeding beyond the manufacturer’s instructions. Later, the state reached a $300,000 settlement with the park regarding the violations.

In this case, although the lawsuit filed by the family needs to be proven in court, it clearly shows how violation of safety procedures can make for key evidence in a Florida personal injury or wrongful death lawsuit.

When can an amusement park be held liable?

In Florida, businesses have a duty to take reasonable steps to ensure that any legal visitor is not exposed to a known risk. In the case of amusement and adventure parks, such a duty includes maintaining rides, enforcing restrictions based on age and height, training employees, proper supervision, inspecting safety devices, and complying with manufacturers’ instructions.

If the business takes no reasonable steps and serious injury occurs, the injured party could make a negligence claim against the business.

However, when there is a death caused by an accident, the surviving family members could file a wrongful death suit under Florida’s Wrongful Death Act.
