Multiple Parties File Lawsuits Against Amazon, Truck Driver Who Caused “Devastating” Crash On I-35

Multiple lawsuits have been filed in a “devastating” crash that occurred on Interstate 35. Victims are seeking more than $150 million combined. One of the survivors has filed a $100 million lawsuit against Amazon Logistics, ZBN Transport, and a truck driver, accusing them of negligence. The crash resulted in multiple deaths and injuries.

According to the lawsuit, the truck driver “barreled down I-35 with “absolute disregard for human life.” The lawsuit states that the victim was driving on I-35 when the truck driver slammed into stopped traffic, hitting 17 vehicles. Five people were killed in the crash, and 11 others were left injured. The truck driver was accused of being on central nervous system (CNS) depressants when the crash occurred. The plaintiff claims that the ensuing crash left him unconscious and mangled his vehicle. In the aftermath of the wreck, he suffered spinal injuries, broken bones, and severe cuts covering his body that left his life permanently altered.

Attorneys for the plaintiff argue that Amazon and ZBN Transport are responsible for hiring the driver and accused him of having a history of reckless driving and safety violations. In his arrest records, the Texas Department of Public Safety noted that the driver had multiple “hours of service” violations in the weeks before the crash.

Several more lawsuits have been filed against Amazon Logistics and ZBN Transport. Many of the claims are for wrongful death, filed by grieving families who lost loved ones in the accident.

Elements of negligence 

In addition to claiming that the driver was intoxicated at the time of the accident, the plaintiffs are also calling into question how many hours the driver worked without taking a rest. Drivers are only allowed to work a certain number of hours during the week and must take periodic rest breaks while operating their vehicles. This ensures that they are not overly tired or strung out from road hypnosis.

Logistically, this case is not very different from many truck accident lawsuits you see filed across the country. Large commercial trucks stop much more slowly than smaller commuter vehicles. Truck drivers must be that much more aware, and their reaction time ought to be superior to that of the average driver.
