Rear-End Truck Accident Results In Negligence Lawsuit Against Driver, Trucking Company

This isn’t the first time we’ve written about an accident caused by a truck driver in which the victim was rear-ended by a semi-truck. It won’t be the last time either. These accidents are disturbingly common.

Recently, an Alabama plaintiff filed a personal injury lawsuit against a truck driver and the company he worked for after the driver slammed into a row of vehicles that were stopped at a red light on Highway 43.

The collision ended up causing the deaths of two people, including an Alabama assistant football coach, and injuring four others. The driver of the semi-truck has since been arrested and charged with two counts of vehicular manslaughter.

The lawsuit names 4 US Freight LLC, 4 US Transportation Company, and 4 US Corporation as defendants alongside the now-incarcerated driver. According to the lawsuit, one of the plaintiffs was left with “serious injuries” after her vehicle was struck by the defendants’ truck. Her lawsuit contends that she was “left hanging upside down—strapped in by her seatbelt and unable to extract herself from the vehicle.” She was ultimately rescued by two bystanders just in time to avoid a fiery death after her Nissan Rogue caught fire and burned.

Allegations against the driver 

According to the lawsuit, the driver was “distracted and/or inattentive and/or impaired” while operating his vehicle. Dash cam footage shows the truck slamming into four vehicles at the red light. The truck completely crushed two vehicles before slamming into the plaintiff’s Nissan. The plaintiff’s attorney contends that this shows that the truck driver did not touch the brakes before crashing into the line of vehicles.

According to the complaint, the truck driver negligently breached his duty of care to follow Alabama’s rules of the road and operate his vehicle safely.

In addition to alleging negligence against the driver, the lawsuit alleges that the company that hired him was negligent for allowing him to drive a truck for them.

Rear-end collisions in truck accident lawsuits 

This type of accident is not unusual. The news is filled with stories of negligent truck drivers who slammed into vehicles that were stopped at a red light, in a traffic jam, or in a work zone. In the vast majority of cases, the driver who rear-ends another vehicle is responsible for the accident. In the case mentioned above, there is no indication that any of the victims contributed any negligence to the accident whatsoever.
