Man Injured In 12-Car Accident Files Lawsuit Against Truck Driver, Trucking Company

A second lawsuit has been filed against a tow truck company and its driver for allegedly causing an accident that led to a fatal 12-vehicle pileup in Northwest El Paso. According to the lawsuit, the plaintiff blames Sheffield Towing Service, also known as Fort Stockton Towing, and the tow truck driver, a 28-year-old man. No attorneys have been listed for the tow truck company. The driver has not been charged with a crime in connection with the fatal crash.

According to the lawsuit, the plaintiff “suffered severe and permanent injuries” during the crash. The plaintiff’s attorney released a statement saying, “Our client is facing a lifetime of pain, medical expenses, and disability. Commercial trucking companies have a legal duty to hire, train, and monitor safe drivers. When they don’t, lives are put at risk, and that’s exactly what happened here.”

The plaintiff is seeking an excess of $1 million in damages for medical care, loss of income, and physical and mental suffering. The attorneys are seeking a jury trial. No trial date has been set.

Elements of negligence 

The plaintiff was injured during a fiery, multivehicle wreck on May 8 at the intersection of Woodrow Bean Transmountain Drive and North Desert Road, according to the lawsuit. The crash occurred at about 6:20 a.m. The driver was driving a yellow Kenworthy tow truck to tow a semi-truck and trailer that broke down on Transmountain Drive, a spokesperson from the police department said.

The driver, “for unknown reasons,” could not stop the tow truck as it approached the intersection of Transmountain Drive and North Desert Road. The tow truck crashed into several vehicles that were waiting at a red light at the intersection. The ensuing wreck involved 12 vehicles, caused one death, and injured seven people.

A passenger in the tow truck died due to his injuries. His family is suing the trucking company and the driver as well. According to his lawsuit, the decedent “was killed in the ghastliest manner imaginable, being burned alive inside the cab of the truck,” according to attorneys who are representing the family.

The lawsuit alleges that the tow truck driver is responsible for the accident, citing several violations and claims of negligence. These include:

  • Failure to use due care in operating a commercial motor vehicle
  • Failure to operate a commercial motor vehicle with sufficient caution
  • Failure to operate a motor vehicle at a speed that was reasonable and prudent under the conditions
  • Failure to control speed
  • Failure to drive in a single lane
  • Failure to keep a proper lookout
  • Failure to pay attention
  • Failure to safely apply brakes to avoid a collision
  • Failure to turn to the left or right to avoid a collision
