Commercial Truck Rear-Ends Driver Causing Serious Injury

A personal injury lawsuit has been filed in connection with a crash that occurred on May 6, 2025, in Thomasville that resulted in the deaths of two people and injuries to several others when a semi-truck crashed into a line of vehicles stopped at a red light. According to one of the lawsuits that have been filed over this incident, the plaintiff, a resident of Tuscaloosa, was seriously injured when her red Nissan Rogue was struck by a semi-truck driven by a 45-year-old driver from Philadelphia, while she was stopped at a red light on Highway 43.

According to the plaintiff’s lawsuit, her vehicle flipped over and skidded down the highway, leaving her trapped upside down until she was rescued by two bystanders. Her attorney said the plaintiff’s vehicle caught fire shortly after she was pulled to safety. She was then transported to Grove Hill Memorial Hospital for treatment.

The lawsuit, which was filed in Clarke County Circuit Court, names 4 US Transportation Company of Chicago and the truck’s driver as defendants. Attorneys for the plaintiff said the driver is currently in the U.S. on a work visa and faces two counts of vehicular manslaughter. He is currently being held in Clarke County Jail. The City of Thomasville continues to investigate the crash.

The plaintiffs say, “Widely circulated dash cam video of the crash shows no sign of the trucker applying his brakes before impact. We are committed to fully investigating this matter and are confident that all the facts will come out.”

The lawsuit is seeking compensatory and punitive damages for the alleged negligence, recklessness, and wantonness of the defendants.

Elements of negligence 

It’s true that when one driver rear-ends another driver, they are presumed to be at fault for the accident. However, it isn’t automatic. There are some cases where the driver who did the rear-ending may not be at fault for the accident. This, however, is not one of those cases. The plaintiff cannot be at fault for the accident because her vehicle was not moving at the time she was rear-ended. The only vehicle that was moving was the truck, which slammed into the back of her vehicle and severely injured her. It’s unclear why the driver didn’t stop in time, but he is facing two counts of vehicular manslaughter. According to dash cam footage, the driver did not even attempt to stop the vehicle before crashing into the plaintiff’s Rogue.

So, basically, the truck driver and the company that he worked for are liable for this accident.
